2. Booking and Payment

2.1. Reservation Confirmation

Your booking is confirmed once we receive the required deposit and a signed charter agreement.

2.2. Payment Schedule

  • Deposit: A 50% non-refundable deposit is required to hold your reservation. This deposit goes toward your rental total.

  • Final Payment: The remaining balance must be paid no later than 48 hours before your charter. Late payments may result in cancellation and loss of deposit.

2.3. Accepted Payments

We accept major credit cards, Zelle, wire transfers, and other secure payment methods.


3. Cancellation & Refund Policy

3.1. Client Cancellations

  • Cancellations more than 48 hours in advance are eligible for a refund (excluding deposit).

  • Cancellations made less than 48 hours before your charter are non-refundable.

3.2. Weather-Related Cancellations

  • If the U.S. Coast Guard issues a Small Craft Advisory or if the captain deems the conditions unsafe, the trip will be rescheduled and given charter credit.


4. Coast Guard Rules & Regulations

We are committed to full compliance with U.S. Coast Guard regulations, and all guests must adhere to the following:

4.1. Passenger Capacity

  • Uninspected vessels (bareboat charters) are limited to 12 passengers maximum, regardless of vessel size.

  • Inspected commercial vessels may allow more than 12 guests, as specified in their Certificate of Inspection (COI).

4.2. Life Jackets & Safety Equipment

  • All vessels are equipped with Coast Guard-approved life jackets and safety gear.

  • Children under 13 must wear a life jacket at all times while on deck.

4.3. Alcohol & Drug Policy

  • Alcohol is permitted in moderation.

  • Illegal substances are strictly prohibited. If drugs are found on board, the trip will be terminated immediately and authorities may be contacted.

4.4. Captain’s Authority

  • The captain has full authority over the vessel and may end the charter at any time due to safety, unruly behavior, or violation of regulations.

4.5. Navigation Zones

  • The yacht must stay within Coast Guard-approved zones unless otherwise authorized.


5. Charterer Responsibilities

  • All guests must follow the crew’s instructions at all times.

  • The charterer is responsible for any damages caused by their party.

  • No diving, jumping off moving vessels, or swimming unless approved by the captain.

  • No disposing of anything in the toilet. (Paper, feminine products, etc.) If the toilet gets clogged the charterer will be charged a $500 fee.

6. Smoking & Shoes Policy

  • Smoking is only permitted in designated outdoor areas (if allowed on that vessel).

  • Shoes must be removed upon boarding unless permitted by the crew.


7. Liability Waiver

Private Yacht Charters Miami is not liable for injuries, accidents, loss of property, or delays beyond our control. Guests assume all risks during water activities.


8. Insurance & Indemnity

We recommend guests carry travel and personal liability insurance. By booking, you agree to indemnify and hold harmless Private Yacht Charters Miami from any claims or liabilities.


9. Governing Law

These terms are governed by the laws of the State of Florida. Any legal disputes must be resolved in Miami-Dade County.
